Parfois reserves the right at all times and by any means to verify the legitimacy of your actions on behalf and for the account of said company.

By accepting these Terms & Conditions, the user acknowledges and declares that he has read, understood and agrees without reservation to the Terms & Conditions, and acknowledges that he is bound by his full compliance with the access to and use of the Website. This Website is owned or operated by Barhold, S.A. a limited liability company duly incorporated under the laws of Portugal, with registered office at Rua do Sistelo, 755, Lugar de Santegãos, 4435-452 Rio Tinto, registered at the Commercial Registry Office under the legal person identifier number 5065810860 (hereinafter referred to as “Parfois”, “we", "us," or "our").

 

2.     Purpose

The purpose of this Website is to provide to Authorized Users (as defined below) a digital platform that offers information related to the promotion of Parfois products and contents. This Website was designed to replace the Spring Summer Parfois Convention, converting it into a digital event due to the limitations caused by the COVID-19 outbreak. The access to and use of this Website aims to fulfill the same purposes of such event.

 

3.     Authorized Users

This Website is intended to be solely accessible to the users specifically authorized by Parfois, to which this Website is strictly reserved (“Authorized Users”). To have access to this Website you must use your password and username. Please note that your given user account and password must be strictly confidential and untransmissible.

If you are a user of this Website, you are entirely responsible for maintaining the confidentiality of your password and user account information. You must notify us immediately in the event of any known or suspected unauthorized use of your user account, or any known or suspected breach of security, including loss, theft, or unauthorized disclosure of your or anyone else's password. You are entirely responsible for any and all activities which occur under your user account. You agree to immediately notify us of any unauthorized use of your user account or any other breach of security known to you.

You also acknowledge that all the information, including without reservation all the technical drawings and documents, samples, models, specimens, equipment, technical processes and other know-how, software, photos, videos, text, graphics, music, sounds, creative suggestions, ideas, notes, drawings, articles, developments and other materials (collectively, "Content") is protected by intellectual property rights, data base rights, patents, trademarks, trade secrets and/or other proprietary rights, and that these rights are valid and protected worldwide in all forms, media and technologies existing now or hereafter developed, originating or succeeding, and whether or not they have been registered.

 

All copyright, trademark and other intellectual property rights in the materials or Content that are provided as part of the Website are at any time owned by Parfois or the licensor, so you may only use such material in the manner herein expressly authorized.

Your access to and use of the Website and Content should, under all circumstances, be in accordance with honest business practices.

The username and password used by the Authorized Users to allow the access to this Website is also strictly confidential.

The confidentiality obligation set forth in this clause is established without detracting from the provisions of any other confidentiality undertaking concluded between Parfois and you/the company on which behalf you are acting, and remains valid and in full force for a period of 5 (five) years after the acceptance of these Terms & Conditions.

The Content on this website is provided "as is" and without warranties of any kind, either express or implied. We disclaim all warranties, express or implied, including but not limited to implied warranties of satisfactory quality for a particular purpose, compatibility, security, or accuracy.

Neither Parfois, nor any of our respective licensors, licensees, service providers or suppliers warrant that this Website or any function contained in this website will be uninterrupted or error-free or that defects will be corrected.

Any Content downloaded or otherwise obtained through the use of this Website is done at your sole risk and you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such Content or material.

Parfois collects the following personal data: name, email address. We will install cookies in your device to collect and store user’s consent to the installation of cookies and to identify and authenticate the user and keeping the user connected even after the browser is closed.

Who are the recipients of your data?

 

Parfois has engaged other companies to the provision of certain services, such as digital suppliers and data centers, namely, but not limited to VEVI Systems, SL. These third parties may need to access to certain information and user data. Parfois ensures that these third parties will only have access to the data that is necessary for the execution of the contracted tasks. Moreover, Parfois ensures that it has entered into an agreement with such third parties to regulate the protection of personal data, under which said third parties undertook not to disclose the data, by any means, nor to use them for any purposes different from the provision of the contracted tasks.

 

Parfois may disclose your personal data when determined by law, in a judicial proceeding or in the context of suspicious activity investigations.

 

Data transfers outside the European Economic Area are not envisaged.

 

For how long do we storage your data?

The data will be stored during the time the Website is available and for the time required to comply with applicable legal or contractual obligations and to exercise and protect Parfois’ rights. Parfois estimates that data collected through cookies will be retained for the maximum period of 1 year counted from the expiration of the Website.

In case there is a pending judicial process, the applicable period shall be of six months after the adoption of a final decision.

The User has the right to obtain clear, transparent and comprehensive information regarding the way Parfois uses their personal data. That is the reason why we provide you with this Privacy and Cookies Policy.

b.    Right of Access:

You can access the personal data we process and keep in your regard. In these cases, Parfois will provide you a copy of the personal data subject to processing.

c.    Right of Correction:

You have the right to correct your personal data in case they are incorrect, outdated or if you intend to complete them. To do so, please contact us by email on dpo@parfois.com.

d.    Right to erasure/right to be forgotten:

You can request us to delete your data. Nevertheless, please note that this is not an absolute right, as we may have legal grounds, namely legitimate interests for the retention of your personal data.

e.    Right to object:

You have the right to object to the processing of your personal data.

f.     Right to, at any time, withdraw your consent:

You can withdraw your consent when it is basis of the lawful processing. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal. Regarding cookies consent, please revert to the Cookies Policy.

g.    Right to lodge a complaint before the National Data Protection Commission (hereinafter referred to as “CNPD”):

h.    Right to data portability:

Within the legal framework, you have the right to move, copy or transfer the data from our database to another.

i.      Right to restriction of processing:

You have the right to request the restriction of your data processing in the following situations: if you dispute the accuracy of the data; if the processing is unlawful and you oppose the erasure of the personal data, requesting the restriction of their use instead ; if Parfois no longer needs the personal data for the purposes of the processing, but the personal data are required by you, or if you have exercised the above referred right to object to processing during the period within which Parfois analyses if the legitimate grounds for processing override those of the data subject.

In order to request the exercise of any of the rights listed above, you shall send a communication addressed to the address above referred in the second point above, to the attention of the Data Protection Officer, or an email to the email address also above referred.
